FREQUENTLY ASKED QUESTIONS

  • What Is the Difference Between Alimony and Spousal Support?

Alimony and spousal support are two terms that are used for the same thing - when a couple divorces, sometimes the higher-earning spouse may be deemed responsible for providing support for the other spouse if it can be proven that they suffer from a great loss of earning potential.

  • How Is Alimony Determined in Georgia?

There is no definitive formula when it comes to calculating alimony. The factors that are considered are the length of the marriage, the needs of one spouse, and the ability to pay by the other spouse. The length of time alimony will be paid also changes on a case by case basis, but the general rule is that the longer the marriage lasted, the longer the alimony will last.

  • What Is the Alimony Law in Georgia?

In Georgia, alimony is not a guaranteed part of a divorce. There are many reasons (such as adultery) where alimony will not be granted. Generally, alimony is incredibly rare for marriages that lasted less than 3 years, and still quite uncommon for marriages that lasted less than 10 years. There needs to be a demonstrated loss of earning potential in order for a spouse to be awarded alimony.

  • Do You Need a Lawyer for Alimony?

If you are dealing with any sort of alimony issue, you should speak to an experienced lawyer. Alimony can quickly become a very complex legal situation, and a family lawyer will be your best bet at a favorable outcome. Technically, the law does not require you to have a lawyer represent you in alimony cases, but in order to ensure a fair outcome, you will want someone with a deep understanding of the law on your side.
